Voluntary Animal Surrender and Relinquishment Agreement

I hereby certify that I am: (     )the guardian (also known as the "owner")     (      ) the authorized representative of the guardian or owner of the animal described below.

I also certify that I have unrestricted and complete authority to convey, surrender and relinquish (collectively, "relinquish") the animal to My Garden of Hesperides ~ HespeGarden Ranch & Rescue, LLC ("HespeGarden") and I hereby further certify that the animal has not bitten anyone in the last 10 days.

By relinquishing this animal to HespeGarden, I acknowledge and agree that HespeGarden shall have the sole and exclusive legal right to make all decisions, and to take all action, regarding said animal.

I understand that there is NO FEE to relinquish an animal to the HespeGarden.

I hereby acknowledge my understanding of, and agreement with, the following terms and conditions that govern the relinquishment of this animal:
  1. Upon arrival at and sole discretion of HespeGarden, animal will be placed in quarantine facility for a minimum of but not limited to thirty (30) days.
  2. All animals will be subject to HespeGarden’s strict NON-BREEDING POLICY. Intact males will be gelded during quarantine period as health permits. All animals re-homed by HespeGarden are subject to fully executed Adoption Agreement with strict NON-BREEDING CLAUSE DISCLOSURE without exception.
  3. If the animal presents an untreatable, irreversible, or otherwise life threatening medical condition at any time during the animal's stay at HespeGarden, the animal may be euthanized -- which means that the animal will be put to death in the most humane manner possible.
  4. Once animal is deemed to be of suitable health & behavior, he/she will either be placed in HespeGarden’s Operation Liberation Herd or placed in a suitable home.

I understand that HespeGarden offers an alternative to me, whereby I may choose to be notified so that I may timely reclaim the animal before it is euthanized. Subject to the following terms and conditions, my choice regarding that alternative is as follows (please initial on the appropriate line):

_____ I do not wish to be notified before the animal is euthanized and I do not wish to reclaim the animal before it is euthanized.

If I initialed the first option (indicating my wish to be notified so that I may reclaim the animal before it is euthanized), I agree that I must physically pick up and reclaim the animal WITHIN 24 HOURS OF THE HESPEGARDEN GIVING NOTICE to me that the animal may be reclaimed.

In that regard, I am solely responsible for maintaining contact with the HespeGarden and for providing the HespeGarden with current contact information for me, which is listed below:

If I have initialed above, indicating that I wish to be notified before the animal is euthanized, and if I provide current and correct contact information in the space(s) listed immediately above, I understand that HespeGarden will, on a one-time basis only:

(a) attempt to contact me by email at one of the email addresses that I provided above; or

(b) attempt to contact me by telephone using one of the telephone number(s) that I provided above (if direct telephone contact is not made with me, an acceptable alternative contact for purposes of this Agreement will be that a HespeGarden representative leaves a message on my telephone or with the person who may answer that telephone).

If I have not physically and actually reclaimed the animal within 24 hours from the time of HespeGarden’s email notification, attempted email notification, telephone notification, or attempted telephone notification (by message), the animal will be humanely euthanized.

If my contact information is incorrect or becomes obsolete, and I do not immediately provide HespeGarden with current email and/or telephone contact information, HespeGarden shall not be obligated to search for such contact information (and HespeGarden's effort to contact me using one of the email addresses or one of the telephone numbers provided above shall be all that is required of HespeGarden for purposes of notifying me of the pending euthanization.

I hereby release the HespeGarden and its employees, staff, volunteers, agents and/or representatives, from any claims or demands that I have, or may have, that:

    1. may be connected with the animal;

(b) may arise out of the HespeGarden's care of this animal; or

(c) may arise out of the HespeGarden euthanizing this animal.
